1. About Matheia and these Terms

Matheia (the “Platform”) is operated by Matimenti Marcin Kobuszewski, a sole proprietorship (jednoosobowa działalność gospodarcza) registered in Poland at 91A, 07-411 Ławy, NIP 7582274330, REGON 526832383 (“Matheia”, “we”, “us”).

These Terms of Service (“Terms”) govern your use of the Platform. By creating an account or using Matheia, you agree to these Terms. If you do not agree, do not use the Platform. Additional terms apply to tutors and organizations who sell through Matheia (the Provider Terms) and to specific features (such as the Refund & Cancellation Policy); where they apply, they form part of your agreement with us.

2. The role of Matheia

Matheia is an intermediary. We provide the software platform that connects students with independent tutors and tutoring organizations, and we facilitate payment between them. We do not provide tutoring ourselves.

The contract for any lesson, package, recurring plan, group class, or cohort is concluded directly between the student and the tutor or organization providing it. That tutor or organization — not Matheia — is the seller and is responsible for delivering the service, for its quality, and for setting its price, schedule, and terms. Matheia is not a party to that contract and does not supervise or guarantee the tutoring provided.

3. Accounts and eligibility

You must provide accurate information when you register and keep it up to date. You are responsible for your login credentials and for activity under your account; notify us at help@matheia.com if you suspect unauthorised access.

Accounts are intended for users aged 16 and over. A tutor may add a student under 16 only with the involvement and consent of a parent or legal guardian, who is responsible for the account. You may hold different roles (for example, student and tutor) and switch between the corresponding workspaces.

4. Booking and receiving tutoring (students)

As a student you can browse tutors and organizations, send booking requests, join cohorts, and pay for accepted bookings through the Platform. Prices, formats, availability, and cancellation terms are set by the tutor or organization, and are shown before you commit.

A booking is confirmed when it is accepted (where acceptance is required) and paid. Reserving a cohort seat is free; you pay only if and when the class forms. You agree to pay the amounts due for the bookings you make, by the deadlines shown.

5. Selling on Matheia (tutors and organizations)

Tutors and tutoring organizations use Matheia to offer their services, manage students and schedules, take bookings, and get paid. If you sell through Matheia, you are the seller of record for your services and additional Provider Terms apply, including obligations around payouts, commission, invoicing, and tax. You are responsible for the lawful and accurate description of your offerings and for delivering them.

6. Payments, fees, and payouts

Payments are processed by Stripe. When a student pays, funds are collected into the connected Stripe account of the tutor or organization providing the service, and Stripe pays them out according to its schedule. Matheia charges the provider a commission on facilitated payments, deducted automatically at the time of charge.

Providers may offer prices in more than one currency; the student is charged in the currency they select. Premium features for tutors and seat-based subscriptions for organizations are billed separately by Matheia and are described where they are offered. Your use of Stripe is subject to Stripe's Connected Account Agreement and terms.

7. Cancellations, refunds, and withdrawal

Cancellations and refunds are governed by the Refund & Cancellation Policy and by the terms the provider sets for their offering. For cohorts, certain outcomes are handled automatically — for example, if a class does not gather enough paying students and is cancelled, paid students are refunded.

If you are a consumer in the EU, you may have a statutory right to withdraw from a distance contract within 14 days, subject to exceptions — including where a service has been fully performed with your prior consent, or for services tied to a specific date or period. Your statutory consumer rights are not limited by these Terms. See the Refund & Cancellation Policy for details.

8. Acceptable use

You agree not to use Matheia to break the law, infringe others' rights, harass or endanger anyone, upload harmful or unlawful content, attempt to gain unauthorised access, disrupt the Platform, or misuse it in any way that harms other users or us. Tutors and organizations must not use the Platform for anything other than legitimate tutoring and education services.

9. Content and intellectual property

The Matheia platform — its software, design, and original content — belongs to Matheia and is protected by law. We grant you a limited, non-exclusive right to use it in line with these Terms.

Content you provide (such as profiles, offering descriptions, notes, and materials) remains yours; you grant us the rights needed to host and display it in order to operate the Platform. You are responsible for ensuring you have the rights to any content you upload.

10. Third-party services

Matheia relies on third-party services, including Stripe (payments), our invoicing provider (invoice issuance), and Google (calendar and drive integrations you choose to connect). Your use of those services through Matheia may be subject to their own terms and privacy policies. We are not responsible for third-party services beyond our integration with them.

11. Availability, suspension, and termination

We aim to keep Matheia available and reliable but provide it “as is” and may change, suspend, or discontinue features. You may delete your account at any time from Settings. We may suspend or terminate access if you breach these Terms, misuse the Platform, or where required by law, giving notice where reasonable. Obligations that by their nature survive termination — such as payment obligations already incurred — continue to apply.

12. Liability

Because Matheia is an intermediary, we are not responsible for the tutoring services provided by tutors or organizations, including their quality, delivery, or any dispute about them. To the maximum extent permitted by law, Matheia's aggregate liability arising from your use of the Platform is limited to the fees you paid to Matheia in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

13. Complaints and disputes

For questions or complaints about the Platform, contact help@matheia.com; we will respond within the timeframe required by applicable law. Complaints about a specific lesson or class should first be raised with the tutor or organization that provided it.

Consumers in the EU may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. This does not affect your right to bring a claim before the competent courts.

14. Governing law and changes

These Terms are governed by Polish law, without prejudice to the mandatory consumer-protection rules of your country of residence. We may update these Terms; we will notify registered users of material changes, and continued use after changes take effect constitutes acceptance. If you do not accept a change, you may stop using the Platform and delete your account.
